TERMS AND CONDITIONS OF PARTICIPATION

Hawaii Photography Workshop

With Alan Schaller & Steve McCurry

22nd August – 26th August 2026

These Terms and Conditions (“Terms”) constitute a legally binding agreement between:

(“the Organiser”, “we”, “us”, “our”) and the individual booking and/or participating in the workshop (“the Participant”, “you”, “your”).

By submitting a booking and/or paying any part of the Workshop fee, you confirm that you have read, understood, and agree to be bound by these Terms.

1. DEFINITIONS

  • Workshop: The Hawaii Photography Workshop delivered between 22nd–26th August 2026.

  • Fee: The total cost payable by the Participant for participation in the Workshop.

  • Booking: A confirmed reservation made by the Participant upon payment of the full fee.

  • Force Majeure Event: Any event beyond reasonable control of the Organiser as set out in Clause 13.

2. ELIGIBILITY

Participants must be aged 18 years or over at the time of the Workshop. The Organiser reserves the right to refuse participation where deemed appropriate in its sole discretion.

3. WORKSHOP OVERVIEW

The Workshop is a professional photography educational programme including guided shoots, mentoring, critiques, presentations, and related activities as described in the Workshop itinerary.

The Organiser reserves the right to modify the itinerary, locations, or format where reasonably necessary.

4. BOOKING AND CONTRACT FORMATION

4.1 A contract between you and the Organiser is formed upon:

  • Submission of a booking request; and

  • Receipt of the required fee; and

  • Issuance of a booking confirmation by the Organiser.

4.2 The Organiser reserves the right to decline any booking at its discretion.

5. FEES AND PAYMENT

5.1 The Workshop Fee is USD $10,000 per Participant.

5.2 Payment schedule: Payment in full on booking

5.3 Taxes (including VAT)

All prices are stated in USD. VAT or other applicable taxes will be applied where required by law and, where applicable, will be clearly communicated at the time of booking.

6. CANCELLATION AND REFUNDS

6.1 Cancellation by Participant

All cancellations must be notified by email.

Refund entitlement:

  • More than 90 days prior: Full amount is refundable less $300 admin fee

  • 30–90 days prior: 50% of total Fee refundable.

  • Less than 30 days prior: No refunds payable.

If you would like to cancel, and we can find another participant to replace you, then you will receive a full refund (less admin fee).

6.2 Transfer of Booking

Transfers may be permitted where the Organiser reasonably agrees and may be subject to an administrative fee.

6.3 Cancellation by Organiser

The Organiser reserves the right to cancel or reschedule the Workshop. In such event:

  • Participants will receive a full refund of Fees paid;

  • The Organiser shall not be liable for any additional costs incurred by the Participant, including travel or accommodation expenses.

6.4 If the Workshop is rescheduled and the new dates are not suitable for the Participant, the Participant may request a full refund of Fees paid.

6.5 Minimum Participant Numbers

The Organiser reserves the right to cancel the Workshop where a minimum number of participants is not reached. In such circumstances, Participants will receive a full refund of Fees paid.

7. TRAVEL, ACCOMMODATION, AND VISA REQUIREMENTS

7.1 Participants are solely responsible for arranging and funding:

  • Flights

  • Accommodation

  • Visas and entry requirements

  • Travel documentation

7.2 The Organiser may provide recommended accommodation options; however, no responsibility is accepted for third-party providers.

8. INSURANCE

8.1 Participants must obtain comprehensive travel insurance prior to attending the Workshop, covering at minimum:

  • Medical expenses

  • Trip cancellation/interruption

  • Personal liability

  • Loss or damage to equipment

8.2 The Organiser reserves the right to request proof of insurance.

9. PARTICIPANT OBLIGATIONS

Participants agree to:

  • Comply with all reasonable instructions issued by the Organiser and instructors;

  • Act in a respectful, professional, and lawful manner;

  • Adhere to local laws, customs, and regulations;

  • Not engage in conduct that may cause harm, disruption, or reputational damage to the Organiser or other participants.

The Organiser reserves the right to remove any Participant from the Workshop without refund in the event of misconduct.

10. HEALTH AND SAFETY

10.1 Participants confirm they are physically and mentally fit to participate.

10.2 Participants must disclose any relevant medical conditions prior to the Workshop.

10.3 The Organiser may refuse participation where health or safety concerns arise.

10.4 Acknowledgement of Risk

Participants acknowledge that the Workshop may involve outdoor activities in potentially hazardous environments, including but not limited to uneven terrain, coastal areas, variable weather conditions, and travel-related risks. By participating, you accept these inherent risks and agree to take reasonable care for your own safety.

11. LIABILITY AND LIMITATION

11.1 Nothing in these Terms shall exclude or limit liability for:

  • Death or personal injury caused by negligence;

  • Fraud or fraudulent misrepresentation;

  • Any liability that cannot legally be excluded under applicable law.

11.2 Subject to Clause 11.1, the Organiser shall not be liable for:

  • Loss of profit, revenue, or opportunity;

  • Indirect or consequential loss;

  • Loss, theft, or damage to personal property or equipment;

  • Injury, illness, or death arising from participation;

  • Acts or omissions of third-party suppliers.

11.3 Participation in the Workshop is at the Participant’s own risk.

12. FORCE MAJEURE

The Organiser shall not be liable for any failure or delay in performance caused by a Force Majeure Event, including but not limited to:

  • Natural disasters

  • Extreme weather

  • Government restrictions

  • War, terrorism, civil unrest

  • Pandemics or public health emergencies

  • Transport disruptions

In such circumstances, the Organiser may reschedule or cancel the Workshop without liability beyond refunding Fees paid (where applicable).

13. INTELLECTUAL PROPERTY

13.1 All Workshop materials, presentations, and content remain the intellectual property of the Organiser and/or instructors.

13.2 No recording, reproduction, distribution, or commercial use of Workshop materials is permitted without prior written consent.

14. IMAGE RIGHTS AND MEDIA

14.1 Ownership of Participant Images

Participants retain full ownership and copyright of any images, photographs, or media they create during the Workshop.

14.2 Use of Participant-Created Images by Organisers

The Organiser may wish to use images created by Participants for marketing, promotional, or educational purposes. In such cases, the Organiser must obtain prior permission from the Participant who created the image before any use. Any agreed use should clearly acknowledge the creator where reasonably practicable, unless otherwise agreed.

14.3 Organiser-Captured Media

By attending the Workshop, Participants grant the Organiser a perpetual, worldwide, royalty-free licence to use photographs, video, or other media captured by the Organiser (or on their behalf) during the Workshop for marketing, promotional, and documentation purposes.

14.4 Opt-Out

Participants who do not wish to appear in organiser-captured media must notify the Organiser in writing prior to the Workshop.

15. DATA PROTECTION

15.1 General Processing

The Organiser will process personal data in accordance with applicable data protection laws. Personal information will be used for the purpose of administering the Workshop and facilitating related communications.

15.2 Related Activities and Communications

The Organiser may also use Participants’ contact details to inform them about other Irys photography activities, workshops, events, and opportunities that may be of interest. Such communications will only be sent where permitted by applicable data protection laws.

15.3 Consent and Opt-Out

Where required by law, the Organiser will obtain the Participant’s consent before sending such communications. Participants may opt out of receiving these communications at any time by using the unsubscribe option provided or by contacting the Organiser directly.

15.4 Data Rights

Participants have the right to access, correct, or request deletion of their personal data, as well as other rights available under applicable data protection laws. Requests should be made to the Organiser in writing.

16. VARIATION

The Organiser reserves the right to amend these Terms where reasonably necessary. Any updates will be communicated to Participants.

17. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

19. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the parties and supersede any prior communications or agreements relating to the Workshop.

By completing a booking, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions.

IRYS PHOTOS WORKSHOPS – PRIVACY POLICY

This Privacy Policy explains how Irys Photos (“we”, “us”, “our”) collects, uses, and protects your personal data when you book or participate in our workshops, including the Hawaii Photography Workshop.

Third-Party Service Providers

We use trusted third-party service providers to help us operate our services and deliver our workshops. These providers process personal data on our behalf and only for the purposes described below:

Stripe to securely process payments and manage transactions

Zapier to automate workflows such as registrations and internal processes

Brevo to send transactional emails and communications

Zendesk to manage customer support enquiries and communications

Irys (irysphotos.com) to host and operate our core platform and user data

These providers may process personal data such as your name, email address, and payment details (where applicable), solely to provide their services to us.

Some of these providers may transfer and store data outside of the United Kingdom. Where this occurs, we ensure appropriate safeguards are in place, such as the use of UK-approved Standard Contractual Clauses.

We do not store or have access to your full payment card details. All payment information is securely handled by Stripe

7. INTERNATIONAL DATA TRANSFERS

As workshops may take place outside the UK (including the United States), your data may be transferred internationally.

Where this occurs, we ensure appropriate safeguards are in place, such as:

  • Contracts approved under UK GDPR

  • Working with reputable service providers

8. PHOTOGRAPHY AND VIDEO

We may capture photographs and video during workshops for promotional and documentation purposes.

  • These may include your image or likeness

  • Use is based on our legitimate interests in promoting our business

If you prefer not to appear in such media, you must notify us in writing before the workshop.

9. DATA RETENTION

We retain your personal data only for as long as necessary:

  • Booking and financial records: up to 6 years (for legal/tax purposes)

  • Communications: as reasonably required

  • Marketing data: until you opt out

10. YOUR RIGHTS

Under UK data protection law, you have the right to:

  • Access your personal data

  • Correct inaccurate data

  • Request deletion of your data

  • Restrict or object to processing

  • Withdraw consent (where applicable)

  • Lodge a complaint with the UK Information Commissioner’s Office (ICO)
